Really BIG Termites. Elemental Mischief Now.

On August 2nd, I and 59% of my fellow Kansas voters rejected an amendment that supermajorities (⅔+) in the Kansas House and Kansas Senate had submitted to us for ratification. No Democratic member of the House or Senate voted for the measure. The constitutional amendment would have eliminated the right to reproductive choice that Kansas women enjoy as a function of their personal autonomy under the Kansas Constitution.

Two more partisan Republican constitutional amendments will go to the vote on Nov. 8.

The first is a direct attempt to destroy in Kansas the separation of powers between an executive, a legislature, and a judiciary, which was first built into the United States Constitution when it was drafted. Call it the “nothing is sacred” change. It’s almost certain that this amendment will come before voters only because the Kansans are adamant about continuing to elect Democratic governors (and Koch Industries wants to be self-regulating).

The second gushed out of this mutant cabal that calls themselves “the Constitutional Sheriffs.” Johnson County is the most populous of Kansas. Johnson County Sheriff Calvin Hayden describes himself as a constitutional sheriff. Hayden has suggested that ballots deposited in Johnson County drop boxes are secretly taken away by gunmen in unmarked vehicles before presumably being delivered to the polling station and counted. Needless to say, Hayden’s proposed procedure is prohibited by law. The above seems like a lot of explanation, but it might be necessary to explain why – according to insiders – this amendment made it to the vote. Like Johnson County, 103 other Kansas counties each elect a sheriff as their respective chief law enforcement officer. But one of them – Riley County – long ago adopted a skills-based administrative structure for the civil service. Johnson County has a strong Democratic bias. The Republican attorney general and gubernatorial candidate is said to have pushed the sheriff’s constitutional amendment to keep Calvin Hayden sheriff.

The only Wichita-based Koch Industries that has supported the “Nothing is Holy” amendment to end the separation of powers (and become self-regulatory) clearly has no respect for American institutions. But they aim higher as they aim to undermine the Republic. Article V of the United States Constitution provides that the legislature ⅔ of states can call a congress to rewrite the United States Constitution. There is no end to the evil and calamity that would follow.

An Article V Convention is now very, very well within reach of Koch Industries.

If the balance of power between the executive, legislature, and judiciary ended in Kansas, we would finally know what happens when a dog catches its tail.

Jumpin’ Josaphat, all of America would be better and stronger if we had more sheriffs like Calvin Hayden.
